1. Scope and Acceptance
These Terms of Sale ("Sale Terms") govern the purchase of digital image files ("Products") from digpic-art (the "Store"), operated by [Your Business Name] ("we," "us," or "our").
By placing an order on our website (https://digpic-art.myshopify.com/), you ("Customer," "you") agree to be bound by these Sale Terms. These Sale Terms are supplemented by our Terms of Service and Return & Refund Policy, which are incorporated herein by reference. In the event of a conflict between these documents, these Sale Terms shall govern the commercial transaction itself.
2. Formation of the Contract
2.1. Offer and Acceptance
- All Product listings on our Site constitute an invitation to treat, not a binding offer.
- When you place an order, you are making a legally binding offer to purchase the Products in your cart.
- We accept your offer and form a legally binding contract with you only when:
- We have successfully received full payment for your order; and
- We have provided you with a download link or made the digital file available for immediate download on the order confirmation page.
- We reserve the right, at our sole discretion, to refuse or cancel any order for any reason, including but not limited to pricing errors, suspected fraud, or stock availability (though stock issues do not apply to digital downloads).
2.2. Order Confirmation
Upon acceptance, we will send you an order confirmation email to the address you provided. This email serves as your receipt and confirmation of the contract.
3. Product Descriptions and Previews
3.1. Digital Nature
All Products are digital goods delivered electronically. No physical items will be shipped.
3.2. Accuracy
We make every effort to display the colors, resolutions, and compositions of our Products accurately on the Site. However, we cannot guarantee that your screen's display of any color, texture, or detail will be precise. Actual printed results may vary depending on your printer, paper, and software settings.
3.3. Specification
You are responsible for ensuring that the file format (e.g., JPG, PNG) and resolution (e.g., 300 DPI, 4K) listed in the Product description meet your specific requirements. All specifications are clearly stated on each Product page.
4. Price and Payment
4.1. Pricing
All prices are listed in Euro and are inclusive of applicable taxes as displayed at checkout. We reserve the right to change our prices at any time, but price changes will not affect orders that have already been accepted.
4.2. Payment Methods
Payment is processed securely through Shopify Payments or our designated third-party payment gateways. You authorize us to charge your selected payment method for the total order amount, including any applicable taxes and transaction fees.
4.3. Taxes
You are solely responsible for any sales, use, value-added (VAT), or other taxes applicable to your purchase. Where required by law, we will collect and remit taxes on your behalf.
5. Delivery and Performance
5.1. Instant Delivery
Upon successful payment and contract formation, you will receive immediate access to download your Product(s) via:
- A download link on the "Thank You" / order confirmation page.
- A download link sent to your registered email address.
5.2. Transfer of Risk
In accordance with applicable digital goods laws, the risk of loss and the transfer of title to the digital file passes to you at the exact moment the download link is made available to you (i.e., when the file is delivered). It is your sole responsibility to download and save the file to a secure device.
5.3. Download Limits
For security purposes, each purchase includes a limited number of download attempts (typically 3–5). If you exceed this limit due to technical issues, please contact us, and we may reset your attempts at our discretion.
6. Right of Withdrawal / Cancellation (EU & UK Consumers)
6.1. Statutory Right
If you are a consumer located in the European Union or the United Kingdom, you generally have a statutory right to withdraw from a distance contract within 14 days without giving any reason.
6.2. Waiver of the Right for Digital Content
Important: Under consumer protection laws (including the EU Consumer Rights Directive and UK Consumer Contracts Regulations), this right of withdrawal expires once you begin downloading or streaming digital content, provided you have given your prior express consent and acknowledged that you will lose your right of withdrawal.
At digpic-art, we require your explicit consent to start the download immediately at checkout. By clicking the "Pay Now" or "Complete Order" button with the checkbox confirming your agreement, you:
- Explicitly consent to the immediate performance of the contract (delivery of the digital file).
- Explicitly acknowledge that you will lose your 14-day right of withdrawal as soon as the download begins.
If you have not yet clicked the download link, you may request to withdraw from the contract within 14 days of purchase by emailing us at info@digpic.art, and we will issue a full refund. Once the file has been accessed or downloaded, no cancellation will be possible under this statutory right.
7. License Grant (What You Are Actually Buying)
When you purchase a Product from digpic-art, you are not purchasing the copyright. You are purchasing a limited, non-exclusive, non-transferable license to use the digital file.
- Personal Use License (Standard): You may display, print, and use the image for personal, non-commercial purposes only.
- Commercial Use License (if purchased): You may use the image in commercial projects as described in the product listing.

8. Limitation of Liability (Sale-Specific)
To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to these Sale Terms or the Product supplied shall be strictly limited to the total purchase price you paid for that specific Product.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or interruption of business, even if we have been advised of the possibility of such damages. This limitation does not affect your statutory rights regarding defective digital content under applicable consumer laws.
9. Entire Agreement for the Sale
These Sale Terms, together with our Terms of Service, Refund Policy, and Privacy Policy, constitute the entire agreement between you and digpic-art regarding the specific purchase of Products, superseding any prior representations or communications.
10. Severability and Waiver
If any provision of these Sale Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of future enforcement.
11. Governing Law and Jurisdiction
These Sale Terms and any contract formed under them shall be governed by and construed in accordance with the laws of France , without regard to its conflict of laws provisions.
For consumers: This choice of law does not deprive you of the protection afforded to you by the mandatory consumer protection laws of your country of residence. Any legal dispute shall be brought exclusively in the courts of Plélauff, France , provided that if you are a consumer, you may also bring proceedings in your local courts.
